Thanks for posting this. I’ve been rereading Republic.com 2.0 lately. I disagree. But at least it’s not disagreeable. Which is to say: Sunstein is obviously very smart.
He is Chicago but not oh so very Chicago. He spends enough time arguing against Hayekians like Posner. Sunstein is close with (married to?) Chicago Philosopher Martha Nussbaum who is about as good-hearted liberal as one can get, and not in the Chicago style.

I think that he is an interesting and very “Obama” variant of the Chicago School that is typical of many of the more centrist types there. Some of the more recent work is, in my view, very much trying to accommodate some of the Chicago orientations to a more robust understanding of the role that government has to play in promoting social welfare.
It would be interesting to know more about what this office actually does — since obviously much of the regulatory action must happen within agencies. So far they have not exactly made the website illuminating in this respect.
Incidentally, he is also known for a philosophy of judicial minimalism, which he shares most prominently with Stephen Bryer.
